Terms and Conditions
The use of the website (the “Website”) is subject to the terms and conditions stated herein. Use of the Website constitutes an agreement by you (the “Client”) that your use is governed by these terms and conditions. In addition, when using the services of Intense Peru S.A.C. (“Intense Peru”) in particular, you will be subject to any guidelines or rules applicable to such services which are periodically updated.
1.1. To secure a booking with Intense Peru, we require 50.00% of the total amount when booking in order to guarantee reservations, and the remaining 50.00% a month (30 days) prior to the initial date of the trip. In case of cancellation, please refer to the cancellation policy further below. The deposit less the money already expended on subcontracted services may be used towards future travels with Intense Peru. Clients’ bookings by telephone or email will be deemed to have read the booking conditions.
1.2. A booking is accepted and becomes definite from the date Intense Peru receives the client’s deposit and personal information. It is at this point that a binding contract between Intense Peru and the Client exists.
1.3. The contract is between Intense Peru and the Client, being all people named on the booking form. The person signing the booking form guarantees that he/she has full authority on behalf of all the people whose names appear thereon, and confirms that all such people are fully aware of and accept these conditions.
1.4. Each booking (including optional tours), confirmation, reduction, extension, or modification must be made/sent to:

Starting and ending dates of the trip
Destinations: Lima, Cusco & Sacred Valley & Machu Picchu, Paracas & Nazca Lines, Arequipa & Colca Canyon, Lake Titicaca & Puno, Jungle Program, etc.
Hotel category (3, 4, or 5 stars) and room type (single, double with 1 full/queen/king-size bed, double with 2 twin size beds, triple)
International means of arrival and departure to Peru (airlines and flight numbers) and schedules
A member of Intense Peru will respond to the Client’s request within one or two working days at the latest.
1.5. In case of tour cancellations, the Client must send his/her request solely to:

A member of Intense Peru will respond to the Client’s request via email within two working days at the latest.
2.1. For Independent Travelers (FITs), the balance due amount must be paid to Intense Peru no later than 30 days before the starting date of the trip. For Groups, 50% of the balance due amount must be paid to Intense Peru no later than 60 days before the starting date of the trip.
Payment may be required ahead of that mentioned in the above paragraph, in the event a service provider requires an earlier payment.
In case we do not receive the first payment due, Intense Peru will treat the booking as canceled by the Client.
2.2. In the case of late bookings (those made within 30 days of the departure date). Full payment of the balance is due immediately, whether is FITs or GROUPS.
2.3. Payment can be made by credit card (Visa, MasterCard, or AMEX) or transferring the total amount of the invoice to our US Dollar checking account. In case of a bank transfer, all wiring and transfer costs should be assumed by the Client.
Any changes to the original booking must be confirmed by email. Any costs or charges which we incur by our suppliers as a result of the amendment(s), will be charged to the Client. While every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed.
If any member of your party is prevented from traveling, it may be possible to transfer the booking to another suitable person, provided that written notice is given at least 30 days prior to departure. An administration fee of US$ 50 will be charged, plus any costs imposed by Intense Peru's suppliers. Airlines may impose 100% cancellation charges and the cost of a new ticket.
The Client may cancel the booking at any time, provided that the cancellation is communicated to Intense Peru by email to your assigned Travel Advisor and copying sales@intenseperu.com. All cancelled reservations are subject to cancellation fees. This is, our cancellation policy depends on the cancellation policy of each vendor considered in each itinerary and quote, as each itinerary varies from one another. Airlines may impose 100% cancellation charges, depending on the airfares booked.
You can request the cancellation policy of your itinerary and quote to your assigned Travel Advisor.
Inca Trail entrance tickets (2 days or 4 days) are not subject to changes, are non-refundable nor transferable if someone cancels.
Intense Peru will charge 6% of credit card payment fees and 10% of the total sales amount in order to cover administrative expenses which involve working hours in designing, elaborating, and making changes to each itinerary and quote, then making reservations, and finally canceling them.
In case part of a booking is canceled, the remaining party may have to pay additional charges (e.g. under-occupancy, single room supplements, or dividing private services by a reduced number of travelers).
While Intense Peru will make its best effort to operate all tours as agreed in the quote and itinerary designed with an assigned Travel Advisor, by entering into this contract the Client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or its contents due to “major changes” in the current local conditions. Therefore, Intense Peru reserves the right at any time to cancel, to change any of the facilities, services, or prices (including flights, accommodation, or other arrangements), to substitute to alternative arrangements of comparable monetary value without compensation, and/or to reimburse the travel services booked. And accepts no liability for any type of loss, damage or lack of liquidity resulting from these changes.
If a “major change” is known to us, the Client will be told at the time of the booking.
If a “major change” becomes necessary after booking, Intense Peru will inform the Client as soon as reasonably possible.
When a “major change” is made, the Client will have the choice of accepting the change of arrangements, purchasing any other available tour, or canceling the tour subject to penalties applied by the vendors considered depending on the time that the major change takes place, provided that the “major change” is not because of force majeure.
Force majeure is war, the threat of war, riots, civil riots, strikes, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, pandemics, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of Intense Peru. Therefore, Intense Peru is also not liable for any charges in the event of a change -beyond their control- to the departure time or date of a tour, flight, or other forms of transport, and not being able to refund partially, or all travel services booked by the Client because of lack of liquidity resulting from an event caused by force majeure.
For any given price increase, Intense Peru will absorb price increase loss if total Intense Peru prices for the Client’s package increase less than 5% for those clients booking/making their initial deposit at least 6 months in advance. If the increase exceeds 5%, the Client will be asked to pay for 100% of the difference.
It is the responsibility of the Client to be in possession of a valid passport, visa permits, inoculations, and preventive medicines as may be required for the duration of the tour. Information about these matters or related items is given in good faith but without responsibility on the part of Intense Peru.
All Clients are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their choosing. Persons over 60 years of age will be advised to obtain medical evidence of fitness to travel on the chosen itinerary. No unaccompanied minors (those under 18 years of age) can be accepted on tours operated by Intense Peru, however, older teenagers may be considered provided they are accompanied by a parent or guardian who accepts full responsibility for them. Intense Peru reserves the absolute right to decline a booking at their discretion. Clients agree to accept the authority and decisions of Intense Peru’s employees, tour leaders and agents, whilst on the tour with Intense Peru. If in the opinion of such person the health or conduct of a Client before or after departure appears likely to endanger the safe, comfortable, or happy progress of a tour, the Client may be excluded from all or part of the tour. In case of ill-health, Intense Peru may make such arrangements as it sees fit and recovers the costs thereof from the Client.
All participants in tours operated by Intense Peru are expected to obey the laws and regulations of the countries visited, and any failure to do so will relieve Intense Peru of all obligations that they may otherwise have under these booking conditions.
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour, in which case all monies paid will be forfeit.
If the chosen holiday includes a cruise or excursion or transfer by boat of any sort, the Client must make it known at the time of booking if he/she is unable to swim. This will not prevent the Client from participating in the tour but will enable Intense Peru to take additional precautions for the Client’s safety at such times as may be appropriate.
If the Client has a complaint about any of the tour arrangements, he/she must bring it to the attention of the tour leader or other representative of Intense Peru at the time so that they may use their best endeavors to rectify the situation. It is only if Intense Peru is made aware of any problems that there will be the opportunity to put things right. Failure to complain on the spot will result in the Client’s ability to claim compensation from Intense Peru being extinguished or at least reduced. Should the problem remain unsolved, a complaint must be made in writing to Intense Peru within 28 days of the completion of the holiday.
Intense Peru will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, it DOES NOT GUARANTEE the fare. The fare can only be guaranteed when the flight booking has been paid for in full and a ticket has been issued. Flight bookings cannot be transferred.
The flight times given by Intense Peru are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets. The Client must check the tickets very carefully immediately upon receipt of the latest timings. Intense Peru will endeavor to inform the Client as soon as possible in the event of any flight alteration. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the holiday arrangements, and will therefore not be entitled to cancel without paying the normal charges as a result.
Intense Peru cannot be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.
Intense Peru cannot guarantee the accuracy of any hotel, resort, or another leaflet which is not published by them but may be supplied as an additional service to the Client.
Intense Peru accepts responsibility for ensuring that the holiday which the Client books with them is supplied as described in the final version of the travel program the Client will receive upon arrival and the services reach a reasonable standard.
Intense Peru acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour or through natural disasters, social upheavals or other causes.
